CityLegends (“we” or “us” or “our”) respects the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information via our website www.CityLegends.io (hereafter: “Site”) and our mobile application (herafter: “Application”), or any other way when you come into contact with us. Please read this Privacy Policy carefully.
The Personal Data that we collect is used for the purposes as set out in this Privacy Policy. We will not use or share your information with anyone except as described.
The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which are accessible at CityLegends unless otherwise defined in this Privacy Policy.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates.
Definitions
For the purposes of this Privacy Policy:
- Account: means a unique account created for You to access the Application;
- Affiliate: means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority;
- Application: means the application provided by CityLegends downloaded by You on any electronic device, named CityLegends;
- CityLegends: means CityLegends, B.V. (also referred to ", "We", "Us" or "Our");
- Device: means any device that can access the Application such as a computer, a cellphone or a digital tablet;
- Personal Data: is any information that relates to an identified or identifiable individual and corresponds with the meaning given to Personal Data in the General Data Protection Regulation (GDPR);
- Privacy Policy: this privacy policy;
- Service Provider: means any natural or legal person who processes the data on behalf of CityLegends. It refers to third-party companies or individuals employed by CityLegends to facilitate the Application, to provide the Application on behalf of CityLegends, to perform services related to the Application or to assist CityLegends in analyzing how the Application is used;
- Third-party Social Media Service: means any website or any social network website through which a User can log in or create an account to use the Service;
- Usage Data: means data collected automatically, either generated by the use of the Application or from the Application infrastructure itself (for example, the duration of a page visit);
- You: means the individual accessing or using the Application, or the company, or other legal entity on behalf of which such individual is accessing or using the Application, as applicable;
TYPES OF PERSONAL DATA COLLECTED
We may collect information about you in a variety of ways. The information we may collect includes:
- Contact information: including but not limited to gender, email, first & last name, birthdate, (shipping) address, telephone number, videos, profile picture, bio, location, country, city, social link, device id, device name, Usage Data, primary account information, payment information and any information that you voluntarily give to us when you register with the Site or our Application, or when you choose to participate in various activities related to the Site and our Application, such as online chat and message boards. We do this based on the performance of our contract with You or when needed, on the basis of you consent.
- Mobile Device Data: Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device. We do this based on our legitimate interest or, when needed, on the basis of you consent.
- Third-Party Data: Information from third parties, such as Personal Data or network friends, if you connect your account to the third party and grant the Site permission to access this information. We do this based on our legitimate interest or, when needed, on the basis of you consent.
- Application Information: If you connect using our Application:
- Usage Data: this may include information such as Your Device's internet protocol address (e.g. IP address), browser type, browser version, the pages of our Application that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
- Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.
- Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.
- Mobile Device Data. We may collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.
- Push Notifications. We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.
USE OF YOUR INFORMATION
Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Site or our Application to:
- To provide and maintain our Application, including to monitor the usage of our Application, based on our legitimate interest.
- For the performance of a contract: to manage your Account, enable user-to-user communications, notify you of updates to e.g. the Site, Applications, new products, services, and/or recommendations to you, the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Application.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as an Application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation. We do this based on our legitimate interest or with your consent when applicable.
- To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information. We do this based on our legitimate interest or with your consent when applicable.
- To manage Your requests: To attend and manage Your requests to Us. We do this based on our legitimate interest or with your consent when applicable, or when in place, the performance of our contract.
- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Applicationusers is among the assets transferred, based on our legitimate interest.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Application, products, services, marketing and your experience, based on our legitimate interest.
- To assist law enforcement and respond to subpoena when we are legally required to do so.
- Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.
We may share Your Personal Data in the following situations, on the applicable legal grounds:
- With Service Providers: We may share Your Personal Data with Service Providers to monitor and analyze the use of our Application, or to contact You. We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. This is done based on our legitimate interests or for the performance of a contract
- For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of CityLegends assets, financing, or acquisition of all or a portion of Our business to another company. This is only insofar this is allowed and necessary four our legitimate interests.
- With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with U, based on our legitimate interests.
- With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions, based on our legitimate interests.
- Under certain circumstances, the CityLegends may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency), based on the fulfilment of our legal obligations.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
RETENTION OF YOUR PERSONAL DATA
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
CityLegends will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Application, or we are legally obligated to retain this data for longer time periods.
TRANSFER OF YOUR PERSONAL DATA
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of the European Economic Area (EER) where the data protection laws may differ than those from Your jurisdiction.
CityLegends will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Personal Data.
SECRURITY OF YOUR PERSONAL DATA
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. In case of use of third parties, we will, in accordance with relevant laws and regulations, ensure applicable processor agreements within and outside the EU/EEA and additional measures if necessary, whereby the security of your personal data is guaranteed by the processor.
TRACKING TECHNOLOGIES
Cookies and Web Beacons
We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site and our Application to help customize the Site and our Application and improve your experience. When you access the Site or our Application, your Personal Data is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site or our Application. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

Internet-Based Advertising
Additionally, we may use third-party software to serve ads on the Site and our Application, implement email marketing campaigns, and manage other interactive marketing initiatives. This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us.
Website Analytics
We may also partner with selected third-party vendors, to allow tracking technologies and remarketing services on the Site and our Application through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site and our Application, determine the popularity of certain content and better understand online activity. By accessing the Site, our Application, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer Personal Data to these third-party vendors. However, if you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool.
You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.
CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and our Applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy./Most web browsers and some mobile operating systems and our Applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. If you set the DNT signal on your browser, we will respond to such DNT browser signals.
HOW DO YOU COME IN CONTACT WITH US TO EXERcISE YOUR RIGHTS?
We respect your rights under the GDPR. We will respond to requests for information as quickly as possible and, where applicable, will correct, amend, or delete your personal information.
In such cases, we will need you to respond with proof of your identity before you can exercise these rights. CityLegends needs to identify you with these types of requests. You can exercise the following rights:
- The right to access information
At any point you can contact us to request the information we process of you. For information that is also present in the Account, we advise you to check that first. There are no fees or charges for the first request. Please note that you can access, update and request to terminate your Account yourself via your Account. - The right to correct and update the information
If the data we hold on you is out of date, incomplete or incorrect, you can inform us and your data will be updated. Some information can be adjusted in the profile, we advise you to check this before you request us to do so. - The right to restrict the processing of personal data
In certain cases you can restrict the processing of your data, for instance if you feel that the data we process is incorrect, and you do not want us to erase your data but restrict the processing. - The right to have your information erased
If you feel that we should no longer be using your data or that we are illegally using your data, you can request that we erase the data we hold. When we receive your request we will confirm whether the data has been deleted or the reason why it cannot be deleted (for example because we need it for our legitimate interests or regulatory purpose(s)). - Withdrawal of given consent
When we process your personal data based on your consent, you have the right to withdraw this at any time. - The right to data portability
If you want us to move your data to another data controller, you can do this in the circumstances that you have provided the data directly to us yourself, this data is processed based on your consent or used in order to fulfil a contract and the data is automated (this right does not apply to paper records). - The right to object to the use of your personal information
You can object to processing of your personal data carried out by CityLegends (including profiling) if this is processed in our legitimate interests, to carry out a task in the public interest or in the exercise of official authority, unless we have legitimate grounds to do so. In the case of direct marketing you can always object to this processing. This also applies to the situation when your data is processed for scientific, historical or statistical research purposes, unless this is necessary for the public interest. Objecting to the processing when decisions are made on an automated basis is possible, unless this is necessary for the performance or entering into our contract, this is authorized by law, or when you have given us your consent. - Right to lodge a complaint with the Data Protection Authority
If you feel that we have not dealt correctly with your personal data, you can lodge a complaint with the relevant data protection authority. In the Netherlands this is the Autoriteit Persoonsgegevens (Postbus 93374, 2509 AJ Den Haag).
